At the CK Power Family of Companies (collectively, the “Companies” or “we” or “our”), we want you to be familiar with how and why we collect, use and disclose information about you.  This includes information we collect through our websites, including without limitation, https://ckpowerfamilyofcompanies.com/, https://ckpower.com/, https://www.cmandw.com/, https://www.hayescouplings.com/, https://www.rmpowertrain.com/, https://terramac.com/, and any of our other websites where we post this Privacy Policy (collectively, the “Websites”) and in connection with the operation of our business and the offering of our products and services.  Some of this information may individually identify you. This Privacy Policy explains our information practices with respect to the information collected and the choices you can make about the collection, access and use of your information.

This Privacy Policy also applies to our targeted content, including online offers and advertisements for our products and services, which we (or a service provider acting on our behalf) may send to you on our third party websites, platforms and applications (collectively, “Third Party Sites”) based on your use of the Internet. These Third Party Sites may have their own privacy policies and terms and conditions. We encourage you to read each such privacy policy and terms and conditions before using those Third Party Sites. This Privacy Policy does not apply to any personal data collected from or about any of our employees.  Personal data collected from any such employees will be protected by our employment policies and handbook.

WHAT PERSONAL DATA DO WE COLLECT AND HOW DO WE USE IT?

We collect information: (i) by which you may be personally identified, such as name, postal address, e-mail address, phone number, personal preferences, or any other identifiers by which you may be contacted online or offline; (ii) that is about you but individually does not identify you, such as IP address or similar online identifiers; and/or (iii) about your internet connection, the equipment you use to access our Websites and usage details (collectively, “Personal Data”).

We obtain Personal Data from the following categories of sources: (i) directly from you (for example, from forms you complete or products and services you purchase; (ii) indirectly from you (for example, from observing your actions on our Websites); (iii) from our affiliates and subsidiaries; and (iv) from third party sources, including information from commercially available sources.

We collect and process Personal Data when we have a lawful basis for processing and such Personal Data is relevant to the purposes for which it was collected or disclosed. Our lawful bases for processing may include your consent or processing necessary for performance of a contract, compliance with laws, protection of vital interests, or legitimate interests of us or a third party. Where processing your Personal Data based on the performance of a contract with you, the consequence of not providing such Personal Data is that we may not be able to perform under the contract and may need to terminate the contract.

In particular, we process Personal Data for the specific purposes described herein. We will retain your Personal Data for the period reasonably necessary to fulfill these purposes unless a longer retention period is required by law. The criteria used to determine our retention periods include (i) the length of time we have an ongoing relationship with you and provide requested products or services to you; (ii) whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

  1. Browsing the Websites – with or without Cookies. For this purpose, we may process information about the type of browser you use, the URL of the page that you are viewing, the title and other details of the web pages you have viewed, your IP address, your Cookie ID, the language settings from your browser and any other information you choose to share when using Third Party Sites (such as when you use the “Like” functionality on Facebook), and the websites you visited before arriving at our relevant Website. Our basis for processing is your consent and our legitimate interests in internal administrative purposes and ensuring network and information security.

We (and third party service providers acting on our behalf or on their own behalf) use cookies and similar technologies to process data about you when you visit our Websites. Cookies are files that store information on your computer hard drive or browser that mean that we can recognize that you have visited us before. We use cookies and similar technologies to operate and improve our Websites, products, and services and your experience on our Websites, analyze site usage, enhance site navigation, personalize your experience, assist in our marketing efforts, and provide social media or other interactive features. We may collect and disclose information, including information about the videos you watch or articles you read, with third parties for these purposes.

You may set your browser settings to reject cookies. However, if you do so, you may be unable to utilize certain parts of our Websites. Unless your browser is set up to reject cookies, we will issue cookies when you visit our Websites, and by accessing our Websites, you consent to our use of cookies. Users can set privacy preferences or signals in their web browsers, such as Do Not Track (“DNT”) and the Global Privacy Control (“GPC”).  At this time, our Websites do not support DNT or GPC codes.

  1. Contact to Deal with Requests, Provide Information about Products, Services or Promotions, and Provide News Releases. For this purpose, we may process your name, postal address, e-mail address, and phone number. We process Personal Data to provide you with the information that you request from us, including responding to your inquiries, testimonials, comments or concerns, sending you products or delivering services that you have requested, and providing news releases. Our basis for processing is your consent, performance of a contract with you, or taking steps at your request prior to entering into a contract.   2. Consider Your Job Application. For this purpose, we may process your name, postal address, e-mail address, phone number, gender, ethnic origin, veteran status, voluntary self-identification of disability, work experience, including job titles, company names, and dates of employment, education, and social security, driver’s license, state identification card, or passport number. We process your Personal Data in order to make employment decisions and to comply with applicable law. Our basis for processing this Personal Data is your consent, performance of a contract with you, or in order to take steps at your request prior to entering into a contract, and compliance with law.   3. Performance of Relevant Administrative Services. For this purpose, we may process your name, postal address, billing address, e-mail address, phone number, payment information, and, in some instances, credit history. We process your Personal Data for the purposes of performing administrative services requested or necessary to facilitate our relationship (e.g., facilitating payments or deliveries of products, services, information or materials). Our basis for processing this Personal Data is your consent and performance of the contract with, or request by, you.
  4. Respond to Complaints and Reports of Business Concerns. For this purpose, we may process your name, postal address, e-mail address, phone number, and relevant information about (i) the complaint or business concern, (ii) the situation or circumstances giving rise to the complaint or business concern and/or (iii) any other Personal Data that you volunteer in your report or follow up communications. We process your Personal Data for the purposes of responding to any consumer complaints or responding to reports from consumers about business concerns related to our businesses and operations. Our basis for processing is your consent with regard to Personal Data you volunteer with regard to your complaint or business concern or a legal obligation to which we are subject.
  5. Prevention of Harm to Us, Our Products or Services or a Person or Property or Defend Ourselves against Claims or Potential Claims. For this purpose, we may process your name, postal address, billing address, e-mail address, phone number, credit history, if applicable, and relevant information about (i) the harm or potential harm, (ii) the claim or potential claim or (iii) the situation or circumstances giving rise to harm, potential harm, claim or potential claim. We process your Personal Data for the purposes of preventing harm to the Companies, their products or services or to any person or property (e.g., fraud prevention) and/or in the bringing or prosecution of a claim or potential claim against you.  In addition, we may process your Personal Data for the purposes of defending the Companies against claims or potential claims made against one or more of them. Our basis for processing is a legal obligation to which we are subject or as necessary for the purposes of our legitimate interests in protecting our business, products, services or a person or property or to defend ourselves against claims or potential claims.

HOW DO WE DISCLOSE PERSONAL DATA?

We engage other companies, including, without limitation, certain of our affiliates and subsidiaries (“Agents”), to perform certain services on our behalf.  We may disclose Personal Data with these Agents to perform the services, and, in fulfillment of the services, these Agents may disclose Personal Data collected on our behalf with us. We use these Agents to provide the following services on our behalf:

  • email and other information technology services;
  • business relations, including marketing services and complaint response services;
  • employee recruitment, career portal and job applicant services; and
  • legal representation, including with regard to prevention harm to our company, its subsidiaries, our products or services or a person or property (e.g., fraud prevention).

In addition to disclosures described above, we may disclose or transfer Personal Data in connection with, or during negotiations of, any merger, acquisition, spin-off, sale of company assets, product lines or divisions, any financing or any similar transaction. We may also disclose Personal Data to prevent damage or harm to us, our services or any person or property, if we believe that disclosure is required to meet legal or law enforcement requirements, or in response to a lawful request by public authorities.  Except as described in this Privacy Policy, we will not otherwise disclose Personal Data to any third parties.

We do not sell or share the Personal Data we collect to any unrelated third parties (who are not Agents) so that they may send you commercial promotions or unsolicited offers for unrelated products or services.  Because we do not sell or share the Personal Data, our Websites do not support GPC codes or similar opt-out preference signals.

When we transfer Personal Data to countries other than the country where it was provided, we do so in compliance with applicable data protection laws, including by utilizing a legally permitted transfer mechanism, such as standard contractual clauses.

LINKS TO OTHER WEBSITES

Our Websites may contain links to websites that are owned and operated by third parties.  These other websites may have their own privacy policies and are not governed by this Privacy Policy.  We are not responsible for the privacy practices or the content of websites owned and operated by any such third parties. Other websites may collect and treat information collected differently.

CHILDREN’S PRIVACY

Our Websites are not intended for children under 18 years of age. We do not knowingly collect Personal Data from children under 18, and, as a result, we do not have actual knowledge that we sell or share the Personal Data of individuals under 18 years of age. If you are under 18, do not use or provide any information on the Websites or on or through any of its features, make any purchases through any Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. YOUR RIGHTS WITH REGARD TO YOUR PERSONAL DATA

To the extent provided under applicable data protection laws, you may have the following rights with regard to your Personal Data: (i) the right to access and know; (ii) the right to rectification (i.e., correction); (iii) the right to erasure (i.e., deletion); (iv) the right to restrict processing; (v) the right to object to processing; (vi) the right to opt out of certain processing, such as the sale of Personal Data or the use of Personal Data for targeting advertising, as applicable; (vii) the right to data portability; and (viii) the right to withdraw consent. We may request certain information for verification purposes, such as your name, address, and e-mail address. We will use this information to verify this is a permitted request, such as by matching your name and address with information in our records. Additionally, if you use an authorized agent to submit a request, we may require the authorized agent to provide proof that you gave the agent permission to submit the request. We may be unable to respond to certain requests or provide Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.

To the extent provided under applicable data protection laws, in response to a request to exercise the right to access and know, we will disclose to you, as applicable: (i) the categories of Personal Data we collected about you; (ii) the categories of sources for the Personal Data we collected about you; (iii) our business or commercial purpose for collecting that Personal Data; (iv) the categories of third parties with whom we disclose that Personal Data; (v) the specific pieces of Personal Data we collected about you (also called a data portability request); and (vi) if we shared or disclosed your Personal Data for a business purpose, a list disclosing the Personal Data categories that we disclosed for a business purpose and for each category identified, the categories or a list of third parties to whom we disclosed that particular category of Personal Data.

Applicable law may contain exceptions to the right to erasure that would allow us not to delete your Personal Data. In responding to your request, we will inform you whether or not we have complied with the request, and, if we have not complied, provide you with an explanation as to why.

We will respond to your requests in accordance with, and within the appropriate timeframe determined by, the applicable law governing the use of the given Personal Data. In most cases, we will respond to requests within one month; provided, however, if the request is complex, we may extend its response time in accordance with applicable law.

We will not discriminate against you for exercising any of your rights. Unless permitted by applicable laws, in connection with you exercising your rights, we will not deny you products or services, charge you different prices or rates, provide you a different level of quality, or suggest that you may receive a different price or rate or a different level of quality of products or services.

If we deny your request, you may have the right to appeal our decision. Further, if you appeal and your appeal is denied, you may the right to complain to your state’s attorney general. You may also have the right to lodge your complaints with applicable legal authorities, including, without limitation, to the extent applicable, E.U. supervisory authorities, the U.K. Information Commissioner, the Swiss Federal Data Protection and Information Commissioner, and/or and the California Privacy Protection Agency.  

For the purposes of this Section, “Personal Data” does not include information specifically excluded from the scope of applicable data protection laws, such as certain publicly available information, deidentified or aggregated consumer information or health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

HOW WE PROTECT PERSONAL DATA

We will maintain reasonable technical and organizational security measures designed to help protect against loss, misuse, and alteration of Personal Data collected and processed by us. However, information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure. As a result, we do not ensure, warrant or guarantee the security or integrity of such information.

We maintain a response plan for security incidents, and we will notify you regarding a security incident to the extent required by applicable law.

CHANGES IN OUR PRIVACY POLICY

We may amend this Privacy Policy at any time.  To the extent required by applicable law, we will contact individuals whose Personal Data is within the scope of such law and then currently being processed by us regarding any material changes to how we collect, use, process, and/or share such individual’s Personal Data or to this Privacy Policy.  In addition, if we make any changes to this Privacy Policy, including any material changes to how we collect, use, process, and/or share your Personal Data, we will post such changes on the Websites.  We encourage you to periodically review this page for the latest information on our Privacy Policy.

YOUR ACKNOWLEDGEMENT OF THIS PRIVACY POLICY AND WHEN WE ASK FOR YOUR CONSENT

By using our Websites, providing us with Personal Data, purchasing our products or services, or otherwise interacting with us, you acknowledge that we are processing your Personal Data in accordance with this Privacy Policy.  If you do not wish that we process your Personal Data in this way, please do not use our Websites, purchase our products or services, provide us with your Personal Data, or otherwise interact with us.

We process your Personal Data as described above. In certain instances, we only process your Personal Data if you have consented (for example, in cases where we process your Personal Data for job applications or seeking employment). Where we process your Personal Data on the basis of your consent, we will ask for your consent explicitly but, in some cases and only where permitted by applicable law, we may infer in a transparent manner consent from your actions.
